Nutzungsbedingungen für Fotett
Diese Nutzungsbedingungen gelten für die Nutzung der Fotett-App.
1. Anbieter

2. Was LensClash ist
LensClash ist ein Sammel-Kartenspiel: Du fotografierst ein echtes Tier, eine Pflanze oder ein Fahrzeug; die App wertet das Foto aus, legt daraus eine Sammelkarte mit Angaben zum Objekt an, und du sammelst, tauschst und kämpfst mit diesen Karten. LensClash befindet sich im Testbetrieb: Funktionen können sich ändern, und wir übernehmen keine Gewähr für ständige Verfügbarkeit.
3. Dein Konto — pseudonym nach Wahl
Du brauchst keine E-Mail und keinen Namen: LensClash legt dein Konto über eine Wallet-Adresse an, die der Server nur als verschlüsselten Quersummen-Wert speichert — er kann deine Adresse daraus nicht herausgeben, auch nicht versehentlich.
Optional, nur wenn du willst: ein selbst gewählter Spielername, eine Anmeldung über Google oder Apple (dabei erfährt unser Server die bei dem Anbieter hinterlegte E-Mail-Adresse) und die Angabe deiner Geräte-Zeitzone — sie dient ausschließlich den täglichen Grenzen deines Scan-Vorrats, wird nie geloggt und nie ausgeliefert.
4. Fotos und Scans — wer dein Bild sieht
Ein Scan-Foto (Tier/Pflanze/Fahrzeug) geht zur Bestimmung im Klartext an ein Bildanalyse-Modell. Welche Empfänger dabei erreichbar sind, benennen wir offen: openrouter.ai (OpenRouter Inc., USA), fal.ai (fal Inc., USA), generativelanguage.googleapis.com (Google) und api.moonshot.ai (Moonshot AI). Welches Modell antwortet, entscheidet unsere Routing-Tabelle — nicht der Code.
Das Porträt-Foto (dein Kartenheld) geht über unser Gateway an fal.ai (fal Inc., USA) und Google (Gemini). Diese Empfänger stehen in deiner Einwilligung beim ersten Porträt — und wenn sich die Empfängerkette ändert, steigt die Versionsnummer der Datenschutzerklärung.
5. Standort — nur so viel wie du freigibst
- Fundort auf deiner Karte: Dein Gerät bestimmt den Ortsnamen selbst und schickt nur die Stadt. Genaue Koordinaten verlassen dein Gerät dafür nicht.
- Kampagne: Für Kampagnen-Aufgaben gehen genaue Koordinaten an unseren Server, der die Stadt in deiner Nähe bestimmt — gespeichert werden sie nicht.
- Werbung (freiwillig): Wenn du es extra erlaubst, geht dein ungefährer Standort an das Werbenetzwerk, damit Anzeigen zu deiner Region passen. Du kannst das ablehnen — die Gravur auf deiner Karte funktioniert in jedem Fall.
6. Benachrichtigungen
Wenn du Push-Ankündigungen erlaubst, speichert unser Server das Geräte-Token (bei Android über Firebase/FCM, bei iOS über den Apple-Dienst) und die reine Auskunft, ob es ein iOS- oder Android-Gerät ist. Du kannst die Berechtigung jederzeit im Gerät ablehnen oder nachholen.
7. Spielregeln
- Deine Scans sind durch Tageskontingente begrenzt; die Grenzen richten sich nach deinem Kartentyp und setzen sich zweimal täglich nach Ortszeit zurück.
- Scanne nur, was du fotografiert hast, und nur, wofür du die Rechte hast (dein Foto, dein Objekt; bei Personen gilt die separate Porträt-Einwilligung).
- Keine Manipulation von Scans oder Bewertungen, keine automatisierten Massenzugriffe, keine Störung des Betriebs.
- Wir können Kataloge, Werte und Regeln anpassen; dein gesammelter Bestand bleibt dabei dein Bestand.
8. Diese Bedingungen und ihre Änderung
Diese Bedingungen sind versioniert: Die App zeigt dir die Fassung, die du bestätigt hast, und speichert sie zu deinem Konto. Ändert sich der Text, zeigt die App den neuen Stand einmalig vor dem Weiterspielen — du stimmst dann erneut zu oder löschst dein Konto. Die aktuelle Fassung steht jederzeit öffentlich unter https://lensclash.de (Nutzungsbedingungen), die Datenschutzerklärung unter https://lensclash.de/app-datenschutz.html.
Bei Änderungen, die bestehende Rechte beschneiden, gilt eine Übergangsregel: Bereits gesammelte Karten und laufende Spiele bleiben nach der bisherigen Fassung behandelt (Bestandsschutz); die neue Fassung gilt erst für die Nutzung nach der erneuten Bestätigung. Wer der Änderung nicht zustimmt, kann sein Konto jederzeit löschen (§9).
9. Konto löschen
Du kannst dein Konto jederzeit löschen: in der App unter Profil → Konto, oder unter https://lensclash.de/konto-loeschen.html. Mit der Löschung endet der Zugriff; was gesetzliche Aufbewahrungsfristen betreffen könnte, entnimmt bitte der Datenschutzerklärung.
10. Haftung
LensClash läuft im Testbetrieb ohne Zusicherung ständiger Verfügbarkeit und wird unentgeltlich bereitgestellt (gemessener Stand: 0 EUR geflossen). Wir haften unbeschränkt nur bei Vorsatz und grober Fahrlässigkeit. Bei einfacher Fahrlässigkeit haften wir nur für die Verletzung wesentlicher Vertragspflichten und begrenzt auf den bei Vertragsschluss vorhersehbaren, vertragstypischen Schaden; die Haftung für die leicht fahrlässige Verletzung untergeordneter Pflichten ist ausgeschlossen.
11. Recht und Gerichtsstand
Es gilt deutsches Recht. Gerichtsstand ist — soweit gesetzlich zulässig — der Sitz des Anbieters (Flensburg).
12. Kontakt und Beschwerden
Fragen zu diesen Bedingungen oder zur Datenverarbeitung richten Sie an kontakt@struck-webdesign.de oder über die Kontaktwege in §1. Zuständige Aufsichtsbehörde für Datenschutzbeschwerden ist die in Ihrem Bundesland zuständige Landesdatenschutzbehörde.
13. Melden, Blockieren, Sperren und Entfernung
Du kannst jeden Spieler melden, dem du in einem Kampf oder als Freund begegnet bist — anhand der konkreten Begegnung, der du wirklich angehört hast. Du wählst einen Grund aus, kannst eine kurze Notiz hinzufügen und optional gleichzeitig blockieren. Du kannst jeden Spieler sperren, auch einen, mit dem du nicht befreundet bist — die Sperre gilt sofort für künftige Begegnungen (Matchmaking, Freundschaftsanfragen); ein bereits laufender Kampf wird dadurch nicht abgebrochen. Nur du kannst deine eigene Sperre wieder aufheben.
Meldungen werden von uns gesichtet. Zum jetzigen, frühen Stand der App geschieht das manuell und ohne feste Bearbeitungsfrist — es gibt noch keine automatisierte Moderation und keine zugesagte Reaktionszeit. Wir behalten uns vor, bei begründeten Meldungen und Verstößen gegen die Spielregeln (§7) Inhalte zu entfernen oder Konten einzuschränken oder zu sperren.

Terms of use for Fotett
These terms of use apply to your use of the Fotett app. The German version above is the authoritative one.
1. Provider
Fridjof Struck — webdesign Fridjof Struck (sole proprietorship), Mathildenstraße 6, 24937 Flensburg, Germany. Contact: kontakt@struck-webdesign.de. Controller within the meaning of the GDPR: Fridjof Struck. Commercial register: not entered (sole proprietorship).
2. What LensClash is
LensClash is a collectible card game: You photograph a real animal, a plant or a vehicle; the app analyses the photo, creates a collectible card with details about the object, and you collect, trade and battle with these cards. LensClash is in test operation: features can change, and we do not guarantee constant availability.
3. Your account — pseudonymous by choice
You do not need an email address or a name: LensClash creates your account from a wallet address that the server stores only as an encrypted hash value — it cannot recover your address from it, not even by accident.
Optional, only if you want it: a player name of your own choosing, signing in with Google or Apple (our server then learns the email address stored with that provider) and your device’s time zone — it serves exclusively the daily limits of your scan quota, is never logged and never shared.
4. Photos and scans — who sees your image
A scan photo (animal/plant/vehicle) is sent in clear text to an image analysis model for identification. We name openly which recipients are reachable in the process: openrouter.ai (OpenRouter Inc., USA), fal.ai (fal Inc., USA), generativelanguage.googleapis.com (Google) and api.moonshot.ai (Moonshot AI). Which model answers is decided by our routing table — not by the code.
The portrait photo (your card hero) goes via our gateway to fal.ai (fal Inc., USA) and Google (Gemini). These recipients are listed in your consent when you create your first portrait — and if the recipient chain changes, the version number of the privacy policy increases.
5. Location — only as much as you allow
- Location on your card: Your device determines the place name itself and sends only the city. Precise coordinates do not leave your device for this.
- Campaign: For campaign tasks, precise coordinates go to our server, which determines the city near you — they are not stored.
- Advertising (voluntary): If you explicitly allow it, your approximate location goes to the ad network so that ads fit your region. You can decline — the engraving on your card works either way.
6. Notifications
If you allow push announcements, our server stores the device token (via Firebase/FCM on Android, via the Apple service on iOS) and the bare information whether it is an iOS or Android device. You can revoke or grant the permission at any time in the device settings.
7. Rules of the game
- Your scans are limited by daily quotas; the limits depend on your card type and reset twice a day by local time.
- Scan only what you have photographed yourself and only what you have the rights to (your photo, your object; for people, the separate portrait consent applies).
- No manipulation of scans or ratings, no automated mass access, no disruption of operation.
- We can adjust catalogs, values and rules; the cards you have collected remain your cards.
8. These terms and their changes
These terms are versioned: The app shows you the version you confirmed and stores it with your account. When the text changes, the app shows the new version once before you can keep playing — you then agree again or delete your account. The current version is always publicly available at https://lensclash.de (terms of use), the privacy policy at https://lensclash.de/app-datenschutz.html.
For changes that cut back existing rights, a transitional rule applies: Cards already collected and games in progress remain treated under the previous version (grandfathering); the new version applies only to use after the renewed confirmation. Anyone who does not agree to the change can delete their account at any time (Section 9).
9. Deleting your account
You can delete your account at any time: in the app under Profile → Account, or at https://lensclash.de/konto-loeschen.html. With deletion, access ends; anything that statutory retention periods could concern, please take from the privacy policy.
10. Liability
LensClash runs in test operation without any promise of constant availability and is provided free of charge (measured status: 0 EUR paid). We are liable without limitation only for intent and gross negligence. In the case of ordinary negligence we are liable only for breach of material contractual obligations, limited to damage typical for this type of contract and foreseeable at the time of conclusion; liability for slightly negligent breach of subordinate obligations is excluded.
11. Law and place of jurisdiction
German law applies. The place of jurisdiction is — as far as legally permissible — the provider’s seat (Flensburg).
12. Contact and complaints
Questions about these terms or about data processing go to kontakt@struck-webdesign.de or via the contact routes in Section 1. The competent supervisory authority for data protection complaints is the state data protection authority responsible for your federal state.
13. Report, block, suspend and remove
You can report any player you encountered in a battle or as a friend, based on that specific encounter. You choose a reason, can add a short note, and can block at the same time. You can block any player, including one you are not friends with — the block takes effect immediately for future encounters; an ongoing battle is not cancelled by it. Only you can lift your own block. Reports are reviewed by us — at this early stage, manually and without a fixed turnaround time. We reserve the right to remove content or restrict or suspend accounts in response to justified reports and violations of the game rules (Section 7).
